1. Hereditas Antiquarium, as Auction House, organises, handles and conducts the auction on behalf of the vendors and acts as a commercial agent.

 

2. Bidding at the auction requires registration at the Auction House, which can be completed via the online platforms of our auction partners, by email, or in person at the auction location. During registration, those wishing to bid must provide the necessary information, including personal data (data management consent, presentation of documents relating to your identity, or references, if determined necessary). Please note that the Auction House reserves the right to refuse the registration and, thus, the participation in the auction.

 

3. The lots called up are presented in succession as in the catalogue. The auctioneer announces the catalogue number and the lot’s starting price, and buyers indicate their wish to bid by raising their cards. The buyer offering the highest bid shall win the lot at the hammer price, except for protected lots, when the Ministry of Construction and Transport’s Inspectorate of Cultural Goods or one of the national public collections has priority to purchase the lot at the hammer price.

 

4. The purchase price includes the hammer price and the 18% auction fee. An additional 5% convenience fee will be charged for bidding through the invaluable.com auction platform.

 

5. The Auction House allows a 14-day grace period to pay the total purchase price. If not picked up until the grace period’s end, a storage fee will be charged, which is 20% of the hammer price. The buyer can only take possession of the item if the total purchase price has been paid. The Auction House reserves the right to consider the buyer’s bid null and void if the buyer fails to take over the item within one month.

 

6. The bid item may not be reauctioned unless the buyer’s identity is impossible to establish.

 

7. All the lots are exhibited for inspection prior to the auction. The descriptions and illustrations in the catalogue are only for identification. The Auction House provides additional photos via email upon request. Each bidder is responsible for inspecting the condition of the lots prior to the auction and deciding if it is in accordance with the description in the catalogue. All the lots are sold without a warranty with all the imperfections they may have at the time of the auction.

8. The items auctioned may not be sold under the starting price in the catalogue. The Auction House will not bear any liability regarding the bid or the purchase price paid and may not be compelled to reoffer the same item or market it at any time at the same price.

 

9. No protected item may be taken abroad (their numbers shall be made public by the beginning of the auction), and the Auction House will register their owners at the Ministry of Construction and Transport’s Inspectorate of Cultural Goods, according to the Act on the Protection of Cultural Goods (LXIV/2001). Owners are expected to report any intention to sell the protected item.


10. In case of the buyer’s absence, the buyer can either place an absentee bid, choose to bid on the phone, or use the online platforms www.axioart.com and www.invaluable.com. Based on a given absentee bid, the Auction House will bid on behalf of the buyer. You may submit bids or apply for phone bidding

Museums and libraries may submit their bids officially without an advance payment. From all other buyers – above 500,000 HUF – the Auction House may require such a fee (20% of the offer). In case of an unsuccessful bid, the advance payment will be returned to the buyer in full after the auction. In case of a successful bid, the amount will be regarded as a deposit.

 

11. Unsold items may be reauctioned after the auction upon request.

 

12. The Civil Code (V/2013) shall govern any matter unregulated in the present Conditions of Sale. Should any dispute arise, the parties accept the competence of the district court, determined by the location of the Auction House.
